شروط وأحكام استخدام تطبيق Makayen

هذه الشروط والأحكام ("الشروط") تمثل اتفاقية قانونية ملزمة بينك كمستخدم للتطبيق ("المستخدم" أو "أنت") وبين مالك ومشغل تطبيق "Makayen". باستخدامك لتطبيق "Makayen" – سواء قمت بتسجيل حساب أم لا – فإنك تقر بأنك قرأت وفهمت وتوافق على الالتزام بهذه الشروط وكافة السياسات والقواعد التي قد يتم الإشارة إليها هنا. إذا كنت لا توافق على أي من هذه الشروط، فيجب عليك الامتناع عن استخدام التطبيق.

1. التعريفات

لغايات هذه الشروط، يكون للمصطلحات التالية المعاني المبينة قرين كل منها:

• "التطبيق" أو "المنصة": يُقصد به تطبيق "Makayen" للتواصل الاجتماعي والفعاليات.
• "المستخدم": أي شخص يستخدم التطبيق أو يصل إلى خدماته.
• "الحساب": الملف الشخصي الذي يمكن إنشاؤه اختياريًا.
• "المحتوى": أي نص أو صور أو فيديوهات أو مواد أخرى.
• "الفعاليات": أي لقاءات أو أحداث أو تجمعات يتم تنظيمها عبر التطبيق.

2. استخدام التطبيق

يجب عليك استخدام تطبيق "Makayen" بشكل قانوني وبما يتوافق مع الآداب العامة وكافة القوانين واللوائح المطبقة في دولة الكويت. باستخدامك للتطبيق، فإنك تقر وتضمن ما يلي:

• الأهلية العمرية: أنك تبلغ من العمر 18 عامًا على الأقل.
• السلوك القانوني: أنك لن تستخدم التطبيق إلا للأغراض المشروعة والمسموح بها.
• الالتزام بالتعليمات: أنك ستلتزم بأي إرشادات أو سياسات استخدام نصدرها.

السلوك المحظور:

لضمان بيئة آمنة لجميع المستخدمين، يُحظر عليك:

• نشر أو تحميل أي محتوى غير قانوني، تشهيري، مسيء، أو ينتهك الآداب العامة.
• مخالفة قوانين دولة الكويت أو قوانين الجرائم الإلكترونية وحقوق الملكية.
• انتحال شخصية أي فرد أو جهة.
• تحميل فيروسات أو برمجيات خبيثة للإضرار بالتطبيق أو المستخدمين.
• إرسال رسائل ترويجية أو مزعجة (Spam) للمستخدمين.

3. إنشاء الحساب والأمان

قد تتطلب بعض ميزات التطبيق إنشاء حساب. أنت توافق على:

• تقديم معلومات صحيحة ودقيقة ومحدثة.
• الحفاظ على سرية معلومات الدخول الخاصة بك، وتتحمل المسؤولية عن جميع الأنشطة التي تحدث عبر حسابك.
• إبلاغنا فورًا بأي استخدام غير مصرح به لحسابك عبر makayenapp@gmail.com.

4. المحتوى والملكية الفكرية

• محتوى المستخدم: أنت تحتفظ بملكية أي محتوى تنشره على التطبيق، ولكنك تمنحنا ترخيصاً عالمياً، غير حصري، ومجانياً لاستخدام وتعديل وعرض هذا المحتوى لتشغيل التطبيق.
• محتوى التطبيق: جميع حقوق الملكية الفكرية للتطبيق، بما في ذلك التصميمات والنصوص والشعارات، تعود لنا ولا يجوز لك نسخها أو تعديلها دون إذن مسبق.

5. إنهاء الاستخدام

نحتفظ بالحق في تعليق أو إنهاء حسابك ووصولك إلى التطبيق في أي وقت إذا قمت بانتهاك هذه الشروط، دون الحاجة لإشعار مسبق. يمكنك إيقاف استخدام التطبيق وحذف حسابك في أي وقت عن طريق التواصل معنا.

6. إخلاء المسؤولية

يتم تقديم التطبيق "كما هو" و "كما هو متاح" دون أي ضمانات من أي نوع. نحن لا نضمن أن التطبيق سيكون خالياً من الأخطاء أو التوقفات.

Makayen App Terms and Conditions

These Terms and Conditions (the "Terms") constitute a legally binding agreement between you as the user of the application and the owner of the "Makayen" app. By using the app – whether or not you create an account – you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must refrain from using the app.

1. Definitions

For purposes of these Terms:

• "App" or "Platform": The "Makayen" social networking and events application.
• "User": Any individual who uses or accesses the app’s services.
• "Account": The personal profile that a user may optionally create.
• "Content": Any text, images, videos, or other materials posted.
• "Events": Any meetups or activities organized through the app.

2. Use of the App

You must use the "Makayen" app in a lawful manner and in accordance with all applicable laws in the State of Kuwait. You represent and warrant that:

• Age Eligibility: You are at least 18 years old.
• Legal Conduct: You will use the app only for legitimate purposes.
• Compliance: You will adhere to our community guidelines.

Prohibited Conduct:

You agree to refrain from:

• Posting illegal, defamatory, abusive, or obscene content.
• Violating any laws, including intellectual property and cybercrime laws.
• Impersonating any person or entity.
• Uploading viruses or malicious code.
• Sending spam or unauthorized promotional materials.

3. Account Creation and Security

Some features require an account. You agree to:

• Provide accurate and up-to-date information.
• Keep your login credentials secure and confidential.
• Notify us immediately of any unauthorized access at makayenapp@gmail.com.

4. Content and Intellectual Property

• User Content: You retain ownership of your content, but grant us a non-exclusive, royalty-free license to use, display, and distribute it to operate the app.
• App Content: All intellectual property rights in the app belong to us. You may not copy or modify any part of the app without permission.

5. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms, without prior notice. You may stop using the app and delete your account at any time.

6. Disclaimer of Warranties

The app is provided on an "as is" and "as available" basis without any warranties. We do not guarantee that the app will be error-free or uninterrupted.
